Understanding Florida's Adoption Record Laws

In Florida, adoption records are sealed to protect the privacy of all parties involved, and that privacy is protected primarily by Florida Statute section 63.162. Accessing these records requires a court order demonstrating “good cause.” Valid reasons may include medical necessity, a desire for personal history, or mutual consent between the adoptee and birth relatives.

Often, the court will appoint an intermediary to act as a liaison between the parties to ensure all parties agree in writing to the disclosure of any confidential information, prior to a “reunion.” An intermediary is defined by law as an adoption attorney or licensed child-placing agency.

Our Approach to Unsealing Records

We offer comprehensive legal support to adult adoptees, birth parents, and other eligible individuals seeking to:

  • File petitions to the court to unseal adoption records.
  • Access non-identifying information, such as medical histories and background details.
  • Act as an Intermediary to attempt to facilitate contact if required by the Court.
  • Conduct a thorough search for birth parent(s) using a Private Investigator search tool.

Recommended Steps for a Successful Search

  1. DNA Testing: We recommend starting with DNA testing through reputable services to identify potential biological relatives.
  2. Register with Florida’s Adoption Reunion Registry (FARR): This free, confidential registry allows adoptees and birth relatives to voluntarily connect if both parties are registered. Learn more and register here: Florida Adoption Reunion Registry.
  3. Consult with Our Legal Team: We will assess your unique situation and advise on the best legal pathways to access records and possibly facilitate reunions. Note this is a highly discretionary decision made by the judge.
